Cases: Kean for Congress v. FEC: Defendant Filings

FEC Renders Decision on Kean for Congress Complaint

On November 21, 2005, the Federal Election Commission rendered its decision on the administrative complaint filed by the Kean for Congress Committee. The FEC's decision came more than five years after the complaint had been filed, and only after the Kean for Congress Committee, represented by the Campaign Legal Center, had brought two lawsuits against the Commission to force a ruling. The FEC found a number of violations of federal campaign finance laws, as had been alleged by the Kean for Congress Committee.

FEC Files Motion for a Voluntary Remand

On Feb. 7, 2005, the FEC filed in District Court a motion for a voluntary remand in the Kean for Congress Committee v. FEC case.

Motion to Hold Plaintiff's Summary Judgement Motion in Abeyance

On June 1, the FEC filed a request asking the court to hold judgement on Kean for Congress' Motion for Summary Judgement until the court decided whether it in fact had jurisdiction. In May, the FEC challenged the plaintiff's standing to file suit.

Defendant Files Reply In Support of Motion to Dismiss

The FEC replied on May 20, 2004 in support of its Motion to Dismiss, reaffirming the commission's challenge to the plaintiff's standing, and alternative Motion for Summary Judgment.

Defense Files Motion to Dismiss

On March 15, the FEC filed a Motion to Dismiss - charging that Kean for Congress lacked standing to challenge dismissal of the original complaint - and alternative Motion for Summary Judgment.

FEC Files Objection to Plaintiff's Claims

The FEC objected to the plaintiff's claims on March 15 that the pending case is related to the previous Kean for Congress case that was dismissed by the commission.
