Cases: North Carolina Right to Life v. Leake: Supreme Court Filings

Petitioners' Documents

On December 22, 2003, the petitioners filed their petition for writ of certiorari with the U.S. Supreme Court. According to the petitioners, the Fourth Circuit's decision in Leake was driven by the bright-line distinction between express and issue advocacy rejected in McConnell v. FEC . Thus, Leake needs to be reconsidered.

Respondents' Documents

On March 23, 2004 , the respondents in Leake v. North Carolina Right to Life filed a brief in opposition to the petition for writ of certiorari. According to the respondents, Leake does not merit review by the Supreme Court. Rather, the Fourth Circuit's rationale is entirely consistent with the Supreme Court's analysis in McConnell v. FEC.
