Appeal Order May 12, 2005

Wisconsin Right to Life (W RT L), plaintiff in litigation against the Federal Election Commission in the US District Court for the District of Columbia , gave notice this week that it is appealing to the U.S. Supreme Court. The case involves an "as applied" challenge to the "electioneering communications" provisions of the Bipartisan Campaign Reform Act. After losing a motion for preliminary injunction before a three-judge court in the summer of 2004, W RT L unsuccessfully sought an injunction pending appeal from Chief Justice William Rehnquist. W RT L has now filed a Notice of Appeal to the Supreme Court challenging the dismissal of its suit.
