FEC: District Court FilingsBush Campaign Case Against the FEC Denied; Campaign Considers Appeal On Wednesday, September 15th, a federal judge denied a request made by the Bush-Cheney 2004 Campaign to force the FEC to act on complaints by the campaign against section 527 groups spending millions this election cycle. The judge issued his ruling from the bench to enable an expedited appeal by the Bush campaign if it chooses to do so. Judge Robertson of the D.C. District Court argued that the FEC is known as a slow agency however, he stated the court was tied to precedents indicating that complainants have limited rights to challenge the FEC for inaction in enforcement matters.
After the ruling the Bush campaign stated that it was considering appeal but that no decisions had been made yet.

Bush Cheney '04 Campaign Files Suit Against FEC Sep 1, 2004
ARLINGTON, VA -- Tom Josefiak, General Counsel to Bush Cheney '04 issued the following statement today:
"Today, the Bush-Cheney '04 campaign moved forward on President Bush's commitment to shut down illegal activities of those soft money 527s that engage in federal elections. Over five months ago, we filed administrative complaints with the FEC to stop certain 527 organizations from their stated goal of spending more than $300 million in banned soft money on the presidential election. To date, the FEC has given no public indication that it has taken any action on the important issues we raised. These particular 527s have already spent more than $63 million on attack ads and $20 million on grassroots voter programs. To prevent these 527s from continuing to violate federal election law, we have asked the federal court to step in and order the FEC to act. The campaign will be filing today in the US District Court for the District of Columbia."
