Legal Center Superior Court Amicus Brief On February 22, 2005, the Legal Center filed a request with the Sacramento County Superior Court of California for permission to submit a brief amicus curiae in Citizens to Save California v. California Fair Political Practices Commission ("FPPC") (Case No. 05AS00555). In June, 2004, the FPPC adopted a regulation making clear that state law limits on contributions to candidates also apply to candidate controlled ballot measure committees. Citizens to Save California, a California state ballot measure committee, along with California Governor Arnold Schwarzenegger and others, have filed a lawsuit challenging the constitutionality the FPPC regulation. The Legal Center's amicus brief supports the constitutionality of the FPPC regulation, arguing that the U.S. Supreme Court has long recognized the threat of real and apparent corruption posed by large contributions to candidates—regardless of the ends to which the contributions are ultimately put. The FPPC regulation, argues the Legal Center, is a constitutionally permissible means of preventing candidate corruption and circumvention of existing candidate contribution limits.
