On August 29, 2005, the Federal Election Commission requested an en banc review of the three-judge Court of Appeals decision upholding the federal district court decision striking down 15 FEC regulations in Shays-Meehan v. FEC.
On October 1, 2004 , the FEC filed a Motion for a Stay Pending Appeal. The motion asks Judge Kollar-Kotelly to confirm that the regulations "remain in effect pending a decision on appeal" and that the judge "stay" her 9/18 Order "to the extent it may obligate the agency to initiate remand proceedings before there is a final judgment on appeal."
On February 10, the FEC filed its Answer to the Complaint filed by Congressmen Christopher Shays (R-CT) and Marty Meehan (D-MA) concerning the FEC's regulations to implement the Reform Act.
