Second Circuit Court of Appeals Strikes Down New York's System for Judicial Nominations

On August 30, 2006 , the U.S. Court of Appeals for the Second Circuit affirmed the district court's order enjoining those provisions of New York Election Law which mandated that political parties use a convention system to nominate candidates for judicial office. In so holding, the Court of Appeals found that New York 's convention system violated the constitutional rights of party members and judicial candidates because it was designed to ensure that political party leaders - not the voters - controlled the outcome of judicial nominations.
