In a friend-of-the-court brief filed in Mobile Republican Assembly et. al. v. U.S. et al., the Legal Center argued that 26 U.S.C. 527(j) was constitutional in all respects and a critical component of the campaign finance disclosure regime. The Legal Center's brief discusses the emergence of the 'stealth PAC' phenomenon and the threat it posed to the integrity of our democracy and the ability of the public to make informed choices in elections. It also emphasizes the continuing importance of 26 U.S.C. 527(j) as a means of supplementing disclosure required by the Bipartisan Campaign Reform Act of 2002 and detecting or deterring violations of the Reform Act.
