"That line between when the person is traveling around on behalf of their, quote, leadership PAC for other candidates and when they're campaigning on their own or helping themselves sometimes gets blurred," said Larry Noble, former general counsel at the Federal Elections Commission and now with the nonprofit Campaign Legal Center.

If Ryan wanted to use footage that Burns has shot in a future presidential bid, the cost would have to be allocated to a presidential committee, he said.

"It's a leadership committee, but at some point, it's testing-the-waters activity," Noble said.
